I am on H1 visa. My last pay stub is dated May 1st 2004. I had been looking for a job for the last one month. I got a new offer and the new employer wants to tansfer my H1. Is there any issue if I transfer my H1 since I was not working for over a month?
----- good chance of RFE for not having recent paystubs or they may approve H1 WITH OUT I-94 attached if that happens then you have to depart US, get H1 Visa stamp and have to enter on H1 status
*** if you work just with H1 transfer filing reciept then your work will be illegal if they deny H1 transfer. Best option is to file through Premium processing so that you get the result in 15-20 days and then join new employer
