Hello Everyone,

Below is my current status.

1. Labor and I 140 approved.
2. priority date as of early 2008.
3. Cannot file I 485 as dates are not current.
4. Completed my 6 years and now on H1 extension (3 years, first extension is expiring in 2011).
5. I am with the same company for last 5 years.

Question -
I have another opportuinity with better position and compensation.

What are the options available to me to proceed with the new company?
Can I have option wherein I can keep my current Priority Date and move to new company?
Is it possible to move to new company as my 6 years are over?

Thanks in advance.

------- Your I-485 is not Pending more than 180 days and you are NOT eligible for AC21.
What are the options available to me to proceed with the new company?
----- do you think your employer will revoke the approved I-140 once you move to ther employer?
Can I have option wherein I can keep my current Priority Date and move to new company?
------ if you have Copy of I-140 approval notice then your or your Lawyer can Capture the early PD. you should ask this question to your new employer lawyer before you plan to move. New employer should be ready to file LC and I-140 for you.

Is it possible to move to new company as my 6 years are over?
----- you can move with H1 transfer but not be eligible for AC21 as no I-485 is filed for you. If your past employer is NOT going to revoke the approved I-140 and you file I-485 based on the I-140 when PD is current for you then you have chance to use AC21.

Thanks in advance.

If the new company is consulting company then I prefer not to move at this time and will wait for my PD to be current and then file I-485 and once I-485 pending hits 180 days then safe to move as one becomes eligible for AC21.
