H1 Transfer or file new H1?

Hello,

My OPT expired on July 10th and my employer A had filed for my H1 on June 4th. I have already recieved my SRC# and also requested them to file for a premium process ASAP.

Meanwhile, I recieved an offer from employer B. Under the present scenario, I have two options.

1. Wait for the approval for H1 with employer A and apply for a transfer as soon as it gets approved.

2. File for a new H1 rightaway.

But we all know the risk associated with option 2 since no one knows when the H1B quota will be reached. Please let me know, under the present circumstances, whats the best option?

You can have two H1s, So let the employer B also file for your H1. If approved you can directly start working with employer B otherwise option 1 will be there (when approved with employer A).

Somebody please correct if I am wrong?


Find out if it is possible to file for transfer after getting the receipt number but before approval. You may consider posting the answer here for others.
