H1 transfer: no paystub needed?

Hi,

I am getting my H1B transferred to another employer. The new employer's attorney requested that I provide (a) copy of passport (b) copy of visa (c) copy of social security card (d) offer letter and (e) resume.

Does the attorney not also need copy of a recent paystubs from my current employer? Mindblowing. He didn't ask for this and I wonder whether there are some new rules or whether this is an oversight on the attorney's part.

Please let me know if any of you have recently transferred your H1 and what documents your attorney needed.

-----may be oversight, may be filling NEW H1 or a bad lawyer who does not know how to file H1 Transfer, you also need new LCA from new Employer that has to be attached with H1 transfer filing

W2 for H1B Transfer

Hi:

Can someone post if we need to produce W2 to: 1) extend H1B with same emoployer and 2) transfer H1B to another employer.

You have any idea why my attorney is asking for W2's for the years 2002 and 2003 for doing a H1B extension.

------ you should ask the attorney why he/she is asking W-2 for H1 extension filing. i dont why he/she is asking .aske him /her and get the answer becase you or your employer is paying him/her for H1 extension.
** W-2 is not needed for H1 extension filing, if your company did any LCA violations in past then lawyer may be trying to show with your W-2 that you were paid as per past LCA if the company has no such issues then W-2 is not needed. But why are you scared of providing copy of W-2??

I am scared because my employer is not paying me the wages shown in LCA.
I think I already mentioned this in someother thread few months ago.

Another question: My employer asking to pay me the attorney fees for my H1B extension which is $ 1200.00. is it against the law?

------ Your employer is violating H1B law/regulation if not paying you minimum according to approved LCA, he can be investigated by DOL can be fined and may be barred from filing H1 or H1 extensions and DOL can also recover your pending wages that he has not paid according to past LCA
I think I already mentioned this in some other thread few months ago.

Another question: My employer asking to pay me the attorney fees for my H1B extension, which is $ 1200.00. is it against the law?
------ By law employer has to pay the H1fees or if he takes the lawyer then pay the lawyer fees, nobody is forcing him to hire lawyer. It is employer who files H1 or H1 extension and it is employer who hires lawyer for H1 or H1 extension he has to pay the fees for H1 extension and any lawyer fees. FYI many lawyer only charge H1 filing $500 to 700

My attorney is asking for $ 1200.00 for filing H1 extension amd also he is asking for the whole fees of 1200 before processing.
I would like to pay half ($600) now and the rest after getting the approval notice.
Also, does any lawyer reimburse their fees if the visa got denied?

Any inputs will be greatly appreciated.

---- By law your employer has to pay the H1 extension fees and lawyer fees, let him find the lawyer who charges less, many charge 500 to 700+ USCIS fees

Hi Ginnu:

I send my papers for H1B extension.
As I already mentioned, my paystub / w2 is less than the $ amount of pay shown in the initial H1. My employer gave a letter saying that my hours is being reduced the adjust the difference in pay. I am really scared about what is going to happen.
Also, I only paid the lawyer fees.
You mentioned me earlier that by law, the employer have to pay the H1B lawyer fees. Is there any link mentioning about that?
