H1 transfer issue

hi

our h1 got expired in 30th sep 08 we extend for next 3 years,after extension got approved v moved to india...
now v r planning to switch over to someother company,wil tey transfer tis h1 to tat company?
is it possible to transfer h1 from india?or i need to come us with company A and switch to different company?

Your H1 extension was filed by US employer and that got approved but you are in India

now v r planning to switch over to someother company,wil tey transfer tis h1 to tat company?
----------------------H1 transfer can be filed when you are on H1 status in US (with latest pay stubs) valid I-94 and if new employer in US is ready to file.

is it possible to transfer h1 from india?

or i need to come us with company A and switch to different company?
------------------Get compant A H1 approval and get H1 visa stamp , come to US work with employer A, get 2-3 pay stubs then find new employer who can file H1 transfer

thanks for ur reply,i'm planning to move to different company in india itself if i moved wat wil happen for my current visa from company A...it vaalid up to 2011...

wil tey cancelled my visa?or is tat another company wil accept?is anyother option available for holding tat visa with different company

--------------------You are working in India and want to change the company in India or want to work with other company in India. While you are in India you are not on H1 status. You are on H1 status when you are in US and working for US employer on H1 status and being paid.
If you still have valid H1 visa stamp in your passport it has nothing to do with your H1 as you are working for Indian employer in India.
The employer A in US can revoke your H1 petition by writing to USCIS and then the H1 Visa that you got through US employer A will be of no use as you cant use that Visa stamp to enter US.

----------------- NO-If you want to come to US on H1 visa and want to work with new US employer then new employer need to file H1 petition for you with USCIS and if that gets approved then you get Visa stamp based on that company H1 approval and come to US.

is anyother option available for holding tat visa with different company
----------------------------Visa stamp is based on particular US employer H1 petition approval. If one has H1 petition approval through US employer X and gets H1 visa stamp based on X approval notice it does not mean that you enter US and start working with Y. Y is not going to give work to you as they don’t have H1 petition approval for you.
