Two years ago, my wife came to the US with H4 visa+EAD when I was still on H1 (I485 pending).
-------- she entred on H4 status (and she also had EAD) if she had EAD it means her derivative I-485 was also filed and pending. it that true? why not provide the full details and make others to guess the situation?

--------- her I-485 was pending and her employer filed H4 to H1 Change of status and she got H1 approval did she got I-94 attached with that H1 approval notice?? if she had I-94 attached and was on H1 status then she may be working on H1 status. it does not matter if EAD expired
Today, she's decided to take a new opportunity at a different employer. However, the attorney told her that her H1 visa is invalid for transfer (the reason is that she was supposed to obtain a "H1 visa stamp" to be a valid H1 visa holder).
-------------- check at her H1 approval notice if she did not get I-94 attached lower right side of the approval then she was supposed to get H1 visa stamp and need to enter on H1 status. if her approval notice had I-94 attached then Visa stamp was not needed and can trasfer H1 with new employer
How can this be true?
She has a copy of the H1 petition.
------- what do you mean by COPY of H1 petition? H1 petition is filed by US employer/Lawyer that should be having form I-129+ LCA. having or getting the petition COPY that was sent to USCIS by employer what you want to know?
Has anyone heard about this?
