I came to the US on an F1 and my wife came on F2. We have not left the country since then.
I got a job at company A and they sponsored my H1B and H4 for my wife. On our approval notices, it says visa valid to 07/04/2008. Then I joined company B which sponsored my H1B. I am currently working with them. However, we did not file for H4 for my wife with company B. I had talked to the immigration specialist for company B and she said we do not need to file I-539 for my wife since the H4 approval notice from company A was valid until 07/04/2008 and that I would have to file I-539 when that date was near. Is this correct?
If not, is my wife out of status. I started working with company B on Sept 2006. Any ideas what we need to do to fix this.
