H1 Transfer in 6th year - Please Help

Hi,

My 6 years of H1-b expires in Apr-2007. My current employer has filed for my labor certification in sept 04. however my employer is not financially stable at this point in time. my question is.. Can i change companies at this point in time (during my sixth year?) also if i do get a job with a new company, how soon can they(new company) file for my PERM so that i can file for my 7th year extension when my 6th year of h1-b expires. Any help on this matter is highly appreciated. :confused:

---------------- ask the new employer if they agree to file LC through PERM it may take 60-80 days to file
so that i can file for my 7th year extension
when my 6th year of h1-b expires.
---- 7th year exensin need to be filed BEFORE 6 year on H1 expire and Before your I-94 expires
Any help on this matter is highly appreciated. :confused:

you can get 7th year H1 extension based on pending LC can trasfer H1 to new employer.

Thanks for your reply.
the problem that i expect with my current employer is financial in stablilty of the company. being a startup company that is still looking for funding its hard not to think what if all funding efforts fail. in such a case they company has only one and that is to close business. hence my thinking is to join find and join a stable company that is willing to joing do my lc under perm immediately. so by next apr next year when my 6 years expire I will can file for the 7 th year extension thru the new company ..I will have to start my gc all over again ..but i will have a shot at staying here.

however If I understand correctly from your reply. I can file for my 7th year extension(apr2007 to apr 2008) with this company and then once it comes then transfer to another company ? btw from now on since my 6 years are over is there anyway i can get an extenstion that is more than one year...do i have to keep doing this every year ?

------------ you can file 7th year H1 extension through this company or new company on the base of LC pending more than one year. it does not matter if A B C or D filed LC it must be pending more than one year to get extension and Extensio need to reach USCIS BEFORE the I-94 expires
btw from now on since my 6 years are over is there anyway i can get an extenstion that is more than one year...
-----------only 1 year if LC pending more than 365 days. can get 3 year H1 Ext if I-140 is approved
do i have to keep doing this every year ?
