I have applied for H-1 transfer from company A to company B. I have not worked for anyone so far as I am still waiting for my SSN. Company B has filed for my transfer couple of days ago which is about 25 days after approval notice.

If by some chance my transfer is denied or if asked for more documents which I am not able to provide, will my H-1 approval be valid with company A?

What happens if I am not able to provide additional documents like letter of reference for the experience which I have shown from back home?

When can my current H-1 approval will be cancelled?

Lastly If company A is getting me into a project while transfer is in process, what shall I do?

Thanks in advance for replying. Plz help me I am in very confused situation.

Your new H1-B should not invalidate your previous one. Your previous one (the one with company A) will be invalidated only if they file for it. SSN isn't a requirement for an H1-B anyway. You didn't need an SSN for your first H1-B, did you?

However, to be real safe, if I were you, I would have waited till I got all my documents. What other documents are you not able to provide? Surely, you got your marksheets, experience letters and other stuff with you, right?

Thanks for the reply.

Yeah thats true that SSN was not required for filing for transfer.

So far I have submitted all documents. When I filed from Company A they showed in my resume experience from back home for few months.
I have no idea whether they submitted experience letter or not.
While transfer I have used the same resume but didnt provide experience letter. I don't know whether they are going to ask for it or not?

If they ask for additional documents and we not able to provide than what happens? Can I withdraw my file if I am not able to provide additional documents like experience letter? If I withdraw will my current H-1 will be cancelled or I can stay on current H-1?

Once again thanks for your comments

While I don't think an experience letter is required for an H1-B transfer, I am not very sure about that. My guess is that you having an H1-B already and paying taxes itself is probably proof enough for them that you are working. They shouldn't be needing anything more.

Most of the times, people transfer their H1-B because they are unhappy with the current company. And no desi company in their right frame of mind would give you an experience letter which would help you leave *them* and hit them on their wallets in the process. If experience letters were a requirement, I doubt anyone would be able to get their H1-B transferred at all. Think about it. Does it make sense?
