H1 Transfer: Gap betwwen Resign and Start/Join Date

Hello.

Thank you in advance for your advice.

Both old/current and new employer's pay cycles start on the 1st and 15th of the month.

So I want to resign from current employer on 10/15/2010 (Friday) and join new employer on 10/16/2010 (Saturday). Since I can't join on Saturday, I plan to join on 10/18/2010 (Monday). Will this two day gap between 10/15/2010 and 10/18/2010, be a problem (out of status)? And should I try to reschedule things so that there is no gap? What if there is a one day overlap?

More Details:
H1B extension filed 8/2/2010
H1B transfer mailed 9/22/2010 with LCA from 10/1/2010
H1B valid until 9/28/2101
Proposed resign date 10/15/2010
Proposed start date 10/18/2010.

Please advise.

Hi Shakil2007,

How did the transfer work out for you? I have a friend who has a similar situation, but the gap is bigger.

H-1B transferred file 11/2, receipt notice received 11/9.
Plan stop work (last day) at Company A on 11/14, and start work at Company B on 12/1 ..

Hi all Gurus,

Is this kind of gap OK in terms of status?

Thanks.

Hello howlongmore.

I changed my last day with company A to 10/17/2010. Joined company B on 10/18/2010. So eliminated gap.

Not sure what a longer gap would mean. Sorry.

Regards.

You can always ask the old employer to keep you on the payroll as if you're on an unpaid leave until the date you start at the new place. Unless they really hate you, there's no reason for them not to do that.
