H1 transfer/ extension issue

My husband is working for a company on h1 which expires in 2004.

Originally he was with an indian co whose h1 is still valid till 2003 april. Now that company is telling that my husband can join them on a mass project, and since 6 months is the time for generally filing for extensions, they would directly file for h1-extension (instead of a h1 transfer as his h1 is valid and active) and simultaenously put him on payroll also. IS THIS ALLOWED LEGALLY. WHAT COULD BE THE REPURCUSSIONS. What are the other ways you suggest to avoid problems joining the old company.

So are they going to pay for the months your spouse did not work for indian company? If so, then it is legal. Otherwise they are better off if they file a H1 transfer.
Use monikors like company A / B etc. in your post to avoid confusion. It took some time for me to decipher what company you are talking about .:)
