h1 transfer - expected denial?

Hi,
I'm working for employer X on H1-B (petition valid till 2010). employer X is not doing legal work. For jun 08 month, I've received payment in Aug 08 month, july 08 month, they r paying me in Sep 08. However, if I look at the paystub, it shows pay date of Jun only. They r trying to look genuine in terms of paystub.

1. If i try to transfer my h1 to another Y & if I join Y based on the receipt of transfer, what r the chances of approval?

2. In case transfer gets rejected, will I go out of status immediately or will USCIS give me a timeframe to leave the country?

3. In case of rejection, can I still come back to US on H4 without any issues?

--------------------------- if you are trying for H1 Transfer with Y then request the new employer Y to file H1 transfer with premium processing and join only once H1 transfer gets approved. If the file with premium process then they can get decision in 20-25 days from the date USCIS recieves the Petition. (no need to inform your present employer that you are going to join Y or Y filing H1 transfer at this time )

---------------------- you will still have employer X H1 valid till 2010 if X dont write to USCIS to cancell your H1 and you can work with X and stay in US.

3. In case of rejection, can I still come back to US on H4 without any issues?

---------------Yes if your spouse is on valid H1 status

Hi,
I'll not be doing premium processing... Can you still give me answers to my questions consider regular process?

If it gets rejected, what will happen? I'll be already joined to Y based on receipt & resigned from X. Can u tell me what will happen?

If joined Y with H1 transfer filing reciept and H1 transfer gets denied then you need to leave US as you will not have any status to stay in US ( If Past Company did not revoke your H1 Petition by writing to USCIS they may take you back)
