Hi
I work for company A. My 6 years on H1 expired in May 06. Company A did file labor certication for GC back in late 2004, under EB3 category. Also they did file my 7th year extension well in advance, and I have H1 approved till May 07 now.
Now the company A is going through RIF process. My questions are:
1. If I am affected, and have another company B ready to hire. Will I be able to transfer my H1 visa to company B?
2. If yes, till when the H1 will be approved. I understand the transfer should be approved till May 07. It this true?
3. Will I be able to extend the H1 with company B, beyond May 07, based on the LCA filed by company A for myself?
-- Here my current company A, has a policy for not sharing the details, and receipt number for the LCA filed. Is this legal? What would be alternative to get 8th year extension with company B?
