H1 Transfer before October

same problem-transfer h1 before Oct

hi,
I posted two messages several days ago regarding to my H1 transfer before October. My new company already filed my new petition with my approval notice which is from my prior employer(7/3/2007). My lawyer told me the USCIS already cashed it and I will get my receipt soon. He said it is no problem to transfer it before October and told me not to worry about it. Besides even if my prior employer write the revoke letter to the USCIS, USCIS usually needs about three months to deal with it. I hope what he said is true. And I am still waiting for my receipt. I will follow up this Q here for people who have same situations like me here as soon as I get the news.

I just got my new H1b receipt lately. (7/13/07).
The receipt No. is different. I feel much safer now. At least I dont need to worry about my prior employer's revoke letter to USCIS.

This looks like to be a very interesting topic and I am in the same situation as well. I am working on OPT now , say for company B, got my H1 approved , which was applied by company A (and H1 will start from October, 2007) and I want to transfer my approved h1 from company A to company B?
I think some other ppl had the similar question.
Anyone who had geniune answer to this question, please reply. Before getting my new job with company B, I was told that if my H1 gets approve then they can easily transfer it without any hassle.

7th year

I'm in 8th yr of extension till April 2008. My labor petition received RFE (due Delaware issue) and my employer is almost giving up.

If I switch my employer now and file labor in PERM and get it approved, say, in 2 months, can I go for 9th year extension with new employer based on pending I140? Please help.
 
H1 transfer or new H1 before Oct

Hello,
I am in a similar situation, but with a different problem. I am currently in H4, filed my H1 through a small-time consulting Company XYZ. With God's grace, I got my H1 approved and the notice has been sent to this Company XYZ. However, I do not wish to take employment through this firm as the terms of employment are not satisfactory. To make the matters complicated, this company is forcing me to take up the employment and threatening that if I do not join them, they'll inform INS to revoke my H1 petition. I need your guidance in,
(1)whether I could get a duplicate petition from USCIS and how do I get the duplicate in my hands rather than USCIS sending to Company XYZ
(2)If answer to #1 is yes, could I be able to do a H1 transfer from a potential employer (Company abc) before October 2007
(3)If answer to #2 is no, could I file for a new petition from the potential employer as I believe that I've already been included in the H1 cap before October 2007

I appreciate all your replies.
