H1 transfer back to previous employer

I have a question about the H1 transfer policies and any insight on my current situation will be helpful.

I transfered my H1 from Company A to Company B in June 2006. Now, in Feb 2007 I want to transfer my H1 back from Company B to Company A. My previous H1 approval with Company A was valid till Oct 2007 & my employer at Company A did not send the notification to the INS about cancellation/transfer of my H1 to Company B back in June 2006.

What I need to know is, how do I go about the H1 transfer.
1. Should I just do a regular H1 transfer back from Company B to Company A jus as in any other case and not worry about the previous cancellation/transfer notification from company A.
2. Should I get back to Company A on my previous H1 with company A and then file for an ammendment after getting a couple a pay-stubs with company A.

Again, let me know what do you guys think about this situation.

I don't think you need to do H1 transfer from Comp B to Comp A in order to work for Comp A again, in case if your old H1 with Comp A is still valid. Someone I know did this 3 years ago, but in his case he worked for the new company only for couple of months, and his New H1 with new company was not stamped at that time.

He didn't file any amendment or anything before or after getting back with Comp A. Since this was 3 years ago, not sure whether anything changed in the recent past.

In your case it won't hurt to consult an attorney to be on safe side.
