A friend of mine is telling me that he got his H1 transfer approved but new H1B Approval Notice does'nt contain I-94... What does that mean.... A possible mistake ?? His previous I-94 that came with the H1 Approval Notice (I-797) that belongs to ex-employer is going to expire in June,2005.

Question : Does he need to go out of the country immediatly and come back to get new I-94 OR he can use his existing I-94 which is valid till June,2005 . Only problem is that it contains his ex-Employer's name. Would that be a problem ?
My friend has no intention to travel outside US anytime in the future.

---- it can be mistake of lawyer he may have filed NEW H1 not extension, check the Form I-129 that is with lawyer and have a look what he wrote on it( lawyer has the copy of H1 filing papers) he may have ticked wrong box on I-129. Or USCIS came to know about his status he may be out of status in past or if USCIS mistake lawyer can request USCIS to correct the mistake

thanks for your prompt response. Kindly also let me know what is your opinion about that I-94 thing.

Ensure that your friend is looking at the approval notice and not the courtesy copy that is sent to the employer. The actual approval notice will have something attached to the bottom with a perforated edge. It will either be an I-94 or a section to be used for consular processing. This needs to be sorted out immediately though since the I-94 controls the status.
