I just returned from a trip to India on my H1 Transfer receipt notice. On arriving i checked the INS automated system at the NSC. Apparently while i was away, there was an RFE to which my attorney responded (i have\'nt found out what it was for yet). There was a message that it will take another 120 days for approval since my prilimary processing has already been done. I dont know what that means. But 120 days is a long time to wait. Does anybody know how long it really takes?
Also, i got married on my recent trip and because of this delay, my wife has not been able to join me here. 120 days it too long a wait. Is there anyway that she can travel on my previous H1 (which is still valid) and the current receipt notice? Another option would be to get her here on a B1 (tourist visa) up until my approval goes through and then we can apply for her H4. Is that something that is acceptable to the INS authorities? or do we need to work around the rules?
I would really appreciate any response or advice in this matter.
