H1 transfer and H4 Question

Hi All,

My husband is switching to a new company and his H1 transfer to the new company is pending still. H1 transfer was applied early november and he has received the WAC no on Nov 10th. It is normal processing. How long do we have to wait for the approval to come in?? It is california service center.

1. I am also working on L1 visa. We want to process my H4 since I will be quitting soon. Can we process my H4 visa while his H1 is still under transfer or do we have to wait till H1 transfer is through.

2. Do i need to travel out of India in order to covert to H4?

3. If his H1 transfer takes time, can we change to premium processing now.

1. Should have filed along with I129. Wait for H1 approval before filing I539
2. Not necessary, but if USCIS issues H4 approval without I94, you need to get H4 stamp in a US consulate
3. recommended.
