H-1 and L-1 Share time. If you've spent 5 years in H-1 and qualify for an L-1B you will have exhausted your time. It would be best instead, to recapture the time you've spent out of the U.S. and remain in H-1B status. For example, if you've spent 100 days outside of the U.S. since entering the U.S. 5 years ago as H-1B, you can extend your H-1B an additional 100 days, by recapturing that time.
