H1 to H4 transfer

Hi All,

My wife is on H1 right now and working with company A. That company is not paying until she gets the project. Lets say if we want to change her visa back from H1 to H4 after waiting for couple of months and that time if we don't have pay stubs, so what can happen? Is it must to provide pay stubs for visa transfer? What are other options?

To change the status from h1 to H4 you do need any pay stub.

I am in the same state. Let us say my wife's H1 starts from Oct 1, 2006. However, she does not find a project and hence is not paid. How soon can she legally stay on H1 ? Does that date need to be before her H1->h4 transfer gets approved or if we just file the transfer application before then, it is ok. Also, since she never started work, will we have to still provide paystub since it would probably be less than a month on her H1 when we file H1->h4 transfer. Thanks.
 
If your wife does not get her first pay check by Oct 15, 2006 and feels future check is problem, get another employer for change of h1. Give the reason (no pay) to attorney he will put it in writing to INS.
