I did my Masters from the US and then started working with company A on H1 in 2000. My 6 yr H1 expires on Oct 2006. I got laid off in Dec 2005 and now on H4. I recently got a job with company B and we just missed filing for the Advanced degree cap. Company A had filed for labor cert in 2004.
Questions are:
1) Do I come under the cap/quota since I already had a H1 but at present am on H4. (I had gone to India for 3 months when on H4)
2) Since company A had filed for labor cert, can I get 7th year extension for company B?
