H1 to H4 is it required?

Hi I have a valid H1 extension till 2007 applied by my company and i am working in US. Due to some health issues I need to resign and stay at home. My husband also holds a valid H1 extension till 2007 and is also working in US. If i resign do i need to apply for h4 as his dependent or can i continue to stay on my H1 since it is valid till 2007 and is not attached to any employer.

or can i continue to stay on my H1 since it is valid till 2007 and is not attached to any employer.
-----as you will not be working on H1 you will not be on H1 statusbut if you take unpaid leave then you can be on H1. talk to your lawyer and your employer
