h1 to h4 i-94 expired

Hi All,
I have quit my job and sent my papers to apply for my h4 but since the i-94 i had has expired, the lawayer says that i have to go back to home country for a status change. Is this true. Is this the only option for me now ??

if you file H4 before I-94 expiration, you are fine to stay in the US til H4 decision is made.
