H1 to H4 change

Hi,

I have few questions regarding visa status change.

I got my H1B visa stamped on Dec 2006 and came to US on Nov 2007. But I could not find a project. As my husband is working here on H1B, I continued here without work. I don't have any pay stubs or w2 yet.
1. Will it be possible to change my visa to H4 while continuing in the US? My H1B is expiring on Sep 2009

My employer told me that if they are not finding a job by now, I have to go back to India and apply for H4 after 2 or 3 months.
2.Will there be a problem to get H4 as I was on H1 before? Will they ask for previous years paystubs/W2 on consulate interview?
3.Is there any other consequences in changing H1 to H4?

-----------------USCIS will not approve your change of status from H1 to H4. you are out of status.
