Hi,
My 6 years on H1 visa will be expiring on Jan 2006. I came to US on Jan 2000. My wife came to US on a H4 visa on July 2002. She is a pharmacist and planning to sit for the FPGEC exam. Say if my wife is able to get a job before Jan 2006 (That is she gets her status transferred to H1 from H4), what are the answer to the following questions:
(i) Can I transfer my visa status to H4 (based on my wife's H1) and stay here, OR do I have to leave the country atleast for a year as my 6 years are over.
(ii)If I can transfer to H4, then can I transfer it back to H1 visa after a year without leaving the country.

Note: I have not started my GC process yet.

Any info on this regard is appreciated.

Thank you.

have to leave the country atleast for a year as your 6 years are over and no LC pending for you by ANY employer more than 365 days

What labor info we need from company X (originally labor filed ) inorder to file for 7 th year extension from company Y?

---- if you are working with company Y then Y can file 7th year H1 extension based on LC filed by X if LC was filed 365 days back

---- When company X filed LC then lawyer got LC filing receipt from SESA or SWA that receipt has your name as beneficiary and receipt date(PD) and case#. You need the copy of that receipt from lawyer/employer and that receipt from SESA or SWA is evidence that LC was filed for you more than 365 days back. Your new lawyer will attach the copy of that LC filing as evidence to file for 7th year H1 extension

Thanks for the reply.

I am not working for Company Y but still i want to apply for the extension. if something happens with company X atleast i will have another choice to work for Company Y
