H1 to GC

Hi, all, first thanks a lot for all the great info!

I have a question:
My current status is H1 and I sent in application for GC based on marriage to a USC. We concurrently filed i-130/I-485/I-131/I-765. A couple of days ago, we received USCIS' receipts for all applications. Now my question is: does that mean I have established status with USCIS? If I am out of H1 status, do I still have a legal status in the States? My boss has been bugging me and I wonder whether I can just quit :( :confused:

Yes. Your A# was generated and you got your receipts, this means that you are covered under the Pending AOS status. In your case, you would still be on H1 (as H1 allows dual intent) as long as it is valid and you dont use your EAD.


If I am out of H1 status, do I still have a legal status in the States?
If you quit your H1 job and dont have EAD, you can stay in the US on a valid legal status as Cherr mentioned. You need EAD to work though.

If you wish to continue employment, you should get your EAD first before you quit your H1 job. If you dont plan to work, you can quit your H1 job anytime.
