H1 to F1?

Hi,

1. Is it possible to convert H1 to F1 after the 6 year H1 limit?
2. Do I have to go to my home country to get the F1 stamped before
   studying?
3. If my wife has already filed for my Green Card, will there be any
   problems for me in getting the Green Card because of this status change?

Has your wife included you on her I140?
If she has not reached that stage you can change to F1.
But once you file I140 you are intention is to immigrate to US.
While F1 and H1 are non-immigrant visa types, which contradict to what you say in I140.
Please be careful in doing what you are doing.

Hi,

1. She has still not reached the I-140 stage.
2. Even at the I-140 stage my name would not be added because it gets added at the 485 stage. So would converting to F1 before she files 485 be fine?
3. But there is one thing, I had filed my 485 on my own. But it will be void if I get layed off. Would that cause problems in getting an F1.

Any comments?

Sorry I myself am a bit lost about the 6 yr limit issue. I just thought may be you could help....

I have only 18 months left out of the total 6 yrs allowed on H1. If I change the employer now to a company in Bay area, CA, and if that company files for my green card in EB2/RIR cagegory, what are the time lines for getting the Labor certification/ I140 / I485 done within these 18 months? I am not uptodate on the CA processing times. Please help. Thanks.

hemant_puri and ssssss: Best thing for both of you would be to go back to India, stay there for one full year and then come back on brand new visas.
