H1 to F1 to H1

Thnx for the responses for my last questions. They were quite helpful.


My Question for now :

I have two more years on H1.

Can I change the status to F1 right now and once I am out of school, can i work for one year on OPT and then use the remaining 2 years of H1 ???

I the mean time, what will happen to my GC processing ??

Dont remember your earlier posts. But yes, you can shift to F1 from H1. But whether you get 1 year of OPT or not will depend on whether you had used 12 months of OPT earlier. If you had used it partially earlier say 6 months, then you get another 6 months of OPT. So 12 months is total. (But I think that if you leave the country for 5 months and then start your F1, you get a fresh 12 months of OPT).

Reg. GC, I dont know. It will depend on the category and stage. I-140 based on EB1-EA or EB2-NIW self petitioned will not be affected.

U R inviting trouble if your GC process is already started and u r planning to go for F1 Visa....

When U apply for F1, u r telling INS that u don't intend to immigrate US permanently. But if U have GC process started then u r lying on your F1 form and that could hurt you in future....
