Hello sir,
I was on H1 b visa and I was laid off back in September 2008. I joined the Masters Program and changed my status to F1 visa which is still pending.
1. Now I have a job offer, will I be subject to the H1b cap in 2009 if I want to switch to H1b again?
2. Is it ok to apply for H1b when my F1 status is still pending? Or should I wait until I receive an approval for F1?
3. If I am not subject to cap, can I apply for H1b at any time of the year or do I have to wait until April 2009 to file H1b?
