H1 to F1 status change with I-20 from community college

I am currently holding H1 visa and would like to change my status to F1.
I already have Master's degree in the US but because of time frame I only can have I-20 from community college.
My husband also needs his status change from H4 to F2.
Because of the level of education, would the petition be rejected?
How much chances would I have?
Also, if the petition is rejected, how much time would the immigration usually allow me to leave the country(something like a grace period)?
Any reply would be greatly appreciated.

Any sensible officer suspect your intention, after a MS you are going to have a AA degree. Better get another I 20 from a private university, incase community college F1 got rejected you can file another one.( Since H1 to F1 takes minimum 90 days, to can shop around). If you do not get one let me know, there are few universities in CA issue I 20 for MS on the spot.
