H1 Termination

Hi,

I came to US few days back(4th november) on valid H1-B
visa. Due to some reasons I am not getting along with
my employer over here and he is telling me that, he
will go to INS and will get my H1 cancelled.

Can u tell me, if he does that, for how long can I
stay in US. And in that period if I get some other
employer, what will be the procedure.

Your plan must include

By legal requirement, employer must report the job termination to BCIS and your status terminates unless you've a pending petition with BCIS. Hence my advice would be -
1. (For time being) be nice to your employer
2. Don't tell him that you'll leave the job
3. Start looking for another employer who can sponsor your new H1
4. You need to have latest paystubs
5. When your next employer files H1 and wait until you have the Receipt number. Then you may quit your current job and legally work for new company.
6. Leave your job in good terms (this is a new land for you)
7. Who knows you might need a good reference in future or experience certificate
8. Take some community college courses like 'communication'. You'll appreciate the benefit it brings by avoiding conflicts.
9. If nothing works as planned, you make a decision that will be beneficial to you and your family. The place you came from has lot of opportunity for career.
10. If my advice doesn't fit your taste, just ignore

I had a word with my existing employer and will continue with him only.
