H1 substitution?

Hi,

I was in H4 and found a job last Oct, and the company sponsored H4->H1 transfering. For family reason, I did not join the company at the end. I assume that my status is still H4. However, I got an email from the company HR last friday that I was still in the company payroll, though I never got any salary from them. So, I'm very confused now. Am I H1 or H4? If I have been in H1, how to cancel it? Could someone else use my H1 to work for the company and got paid?

if you did change of status(I-539) last year, your status has been H1 since last Oct. Company is supposed to pay salary to all the sponsered H1s and that is why their document/computer says you are still on payroll.

There is no H1 substitution allowd therefore no one else can work under your H1.

Right now you are treated as out-of-status as you are on H1 and not getting paid. It will create lot of issue if you are thinking about GC. So get few paystubs ASAP and discuss the situation with attorney/company immediately.
