My wife has an approved I140 and waiting to file for her 485. She presently is in H1 status. But we have to go to Canada to maintain our PR card there. But once the numbers become available we would like to come back in and file 485 and get a work permit...

How can we do that ? do we really need to be getting paid here or we just need to get a letter from the employer stating that she is working for the company in US so that we an re-enter USA ?
So how do we maintain the status...
 
But what do I need to maintain the H1 employment. she will be getting paid and on payroll. but she will be residing in canada.
 
It is ashame that you are denying the opportunity of h1 status for a legitimate worker when the number of visas available are so limited. Try obeying laws of the United States before seeking permanent residency here.
 
It has no impact as Number is already counted & it is counted once!!!

No need for Slamming. They have simple question so if you don't know just say so.

H1B numbers are counted once. so they are not denying any opportunity any one else.

As per my understanding- it should be OK. I have worked overseas for a period of 9 month & I was in status of H1B as was getting paid through US employer. I would suggest to check with the attorney who is getting paid to handle your GC case.

The laws should also be fair and not hijack the lives of people working hard and contributing to the economy. Behind this one question there can be the life of everyone in the family depending upon.

Sir/Madam I beg to disagree. I have been in this country for 8 years. Having been a director of s/w development i have created many many jobs in this country with american citizens mind you not h1 jobs. due to health concerns i will have to be in the american continent else i can always take these jobs back to my home country. and of course i really like the country and the people here. But because of the delays in GC process i will have to either maintain or loose my canadian PR. If i decide to loose my PR in Canada that would mean that I must get my GC here which may or may not possible...

I am well aware of all regulations regarding immigration. I am also well aware that it is counted once. I believe that those working hard IN THE UNITED STATES and not submitting fraudulent documents deserve to stay here. APPEARING to work in the United States in order to obtain documents is illegal and wrong. Such actions mock those in this country legitimately trying to earn pr.

Being paid by sponser, working abroad does not make you lose your H1.
Some people can have long term assignment abroad under H1.

Only concern is when you extend your H1, you need to provide your address in application form. You have to put your canadian address, which
i do not know how CIS responds. It may be possible for them to say you do not need H1 as not living in the US.

Im legitimate in the country have been for 8 years now. im not just appearing to work for comapny here infact i will be. as i said before if i decide to go out of the country and setup place you can also kiss goodbye to 10+ jobs.
