Hi!

I will be going to the Mumbai visa consulate for first-time H1 stamping in Feb. I was on F1 visa before and then on OPT. I work for a very small company (4 employees) that has government contract. My first perition for H1 visa was rejected and the second one was approved. Please could someone tell me additional documents (e.g. Company brochure, Pay stubs photocopies of other employees, Contracts information etc.) that I need to carry? Also has anyone had a similar problem while getting the visa stamped and working in a small company?

Please help me! I am worried that my visa will be rejected.

We just started a company and got our first H1 visa approved and Stamped in Mumbai. You have to prove that the company has office location and financial backing to pay your salary for atleast 3 - 4 months. Also get documents like 941 forms from your company. All H1 information that were stamped in Mumbai etc....

You have to be confident in the interview to get your H1 approved. Small company does not necessarily mean REJECTION. IT ALL DEPENDS ON HOW YOU REPRESENT YOURSELF.

Thanks a lot for your advice. Could you please let me know the exact documents that I need to get from my employer other than 941 (employers bank statement, contract information etc.) for proving financial capability? Also is it enough to show photos of the company or do I need to show the lease agreement?

Thank you.

We had mailed out the following documents to our consultant in India -
1. 941.
2. Bank Financial Statement.
3. Photos of our office(with people working, name plate, directory name etc.)
4. Copies of our contract where the consultant will be working.
5. We had also submitted detailed business plan(but it is not necessary if the company is purely consulting. But they need to atlease mention their financial forecast for the next year.)
6. Floor plan of the office.
7. Lease agreement for the office.
8. Recommendation letters about services provided from our current clients.
9. Employee Contract Document(Original. Make sure you carry this because sometimes they might check it to make sure the company will pay you on bench)
10. Employee Offer Letter(Original).
11. LCA document.
12. Educational Evaluation Document.
13. Copies of documents that were submitted to INS for your H1 visa(I-129, I-129F etc...)

Any other documents that would prove that the company is legal and not just on paper. If this is your first H1 visa these documents would be must. Our consultant's visa was not his first visa, so they did not ask him for any of the above documents. But I have heard people being given 221 reason for the above documents. You don't want to spend time in India waiting for your company to send these documents. So, go prepared for your visa.

Thanks a lot! I will carry all these documents with me. One last question. Our company is collaborating with a University and our company was mentioned in an article of Universities newsletter. Do you think I should carry the newsletter to show the existence of the company?
