H1 stamping -Clarification

Dear all,
   I had my H1 stamped (revalidated) from State Department in 1999 for company X. That visa is valid till the end of 2002.
 Now I am working for company Y. I plan to go to India in next few weeks. My lawyer says I need to get my visa stamped again (if I go to India). However, I don\'t agree. All I need is a valid visa and the new I-797 to get back into the USA.
    Let me know if something has changed since 9/11. If there are any new rules that require visa stamp change, please inform me.

You are correct, you do NOT need a new visa stamp

Just show your latest approval notice at POE and you should get an I94 date based on the new approval.

Hello my friend,

I would be very very careful on this issue and if I were you I\'ll take your lawyers advice. Immigration officer has the right/obligation to ask for your current employment letter. It happens to me before.

Hence, if your employement letter is different than the employer on your visa, they have the descretionary power to deny entry.

I\'m just sharing what happened to me. I\'m not saying it will happen to you. But I\'ll be cautious on this issue, especially thru nowadays. All the best.

I did my trip on company A\'s visa, valid till 2003 with company B\'s H1 approval notice recently. I departed before Christmas 2001 and came back after New Year 2002. On my return at San Francisco Airport, INS officer asked two questions,

1. Where you will go?
2. What is your job title?

Then new I-94 issued with the valid date matched company B\'s H1 data 2004.
