h1 stamping after xfer

Hi,

I am currently in USA and my h1 xfer has been completed and I have received the new I-797 form.

1. I plan to go to Toronto for stamping purposes. Does the visa get stamped on the same day itself? If not, how long does it take and can we know this duration prior to reaching there?
2. Can I travel to India and return to US without getting the visa stamped?

If anybody can share their experiences then it will be really helpful. Thanks in advance.

Cheers,
San

I would plan for a week for visa stamping in Canada. You can return to the US after a trip from India without visa stamping if the visa stamp on your passport is still valid.

Make sure the PMIS information is updated by following procedures mentioned on the forum. That might help cut down the processing time for your visa, no guarantee though.

Guys, thank you for your quick replies. A few more questions:

1. How do I make sure that PMIS is updated with the latest information?
2. My visa stamp on the passport will be valid when I return from India but this stamp is of my ex-employer. Can that cause any issues?
3. I have heard that the stamping can be done within a day in Mexico as compared to a week in Canada. What are your views on it?

Thanks again guys.

Cheers,
San

People had success emailing a scanned copy of the I797 and appointrment letter to the consulate's email address and got PMIS verified. Check immigration forums for details or nvars for email address.

For question #2, yes you can re-enter US with visa stamp from previous employer ... plesae keep the new I-797 approval notice handy, in case that was asked for.

If you have an existing visa stamp from your previous employer that is unexpired, you can save yourself the visit to the consulate as it is not needed. You can travel with your new approval and old unexpired visa.
