    NOW TURN C

    Employer B (H1B) has clicked a good job openeing with Employer C (corp2Corp Basis) who has commited to Hire after 3 months i.e. H1B transfer from Emplr-A to Emplr-B). Would like to confirm the following:

    Can I start work immediately (Oct 5, 2009) on H1B.??

    1) My understanding from Attorney during Turn A found that I have to go out of USA and get H1B Visa Stamped and re-enter again with family. There is no way ? Is it true?

    2) Employer B says I do not need to go out, they can file an amendment to get new I-94 and I can start work immediately on H1B. (Note my current L1B expiring on 5-Oct-2009).

    3) Can Employer C file H1B immediately and can I start work immediately with Employer C ?

    Turn A

    1) On May 15 Employer B filed H1B with COS (change of Status)

    2) On July 9 H1B-COS Approval received effective from 1-Oct-2008 to 24-Sep-2011


    Turn B

    To Save my L1, it was recommended to go out of USA and re-enter on L1B again (to get new I94)

    1) Went to Bahamas via ship on 23 Feb 2009 and return on 24th Feb 2009 to get new I94 (latest I94) and continued to work on L1B with Employer A.

    I will be grateful if you can please help me to get out of all tension... it is very typical L1 / H1 COS case but making me made to make decision.. what to do ?

    Following are the details which may help you understand my case:

    1) Came on L1B with (Employer A) on 19-May-2007

    2) ....(Turn A described below)..

    3) Went out on vacation to India on 8-Aug-2009

    4) After Vacation, entered USA again on L1B on 6-Sep-2008

    5) ...(Turn B described below)

    4) Employer A is filing extension of L1 (Change to L1A from L1B and extension) as it is getting expired on 5-Oct-2009
