Dear All,

This may be dumb. Pardon me if it is. I know that staying past the date on I-94 is illegal and my husband and I are finishing our first term in H1 and our date on 1-94 is 20 apr 2007.

My husband will apply for the next 3 years of stay by december because the lawyer suggested it should be done 4 months before expiry.

Now my question is after the next 3 years is approved, when should I get it stamped for visa? Is it to be done before 20 april 2007 or can you wait until you want to leave the country for some reason like many do for their first 3 years?

Thank you.

---------- one can file extension 6 months before the expiry of I-94

--------- once Extension gets approved you can stamp the visa or you can get stamp when you go out, with extension papers and attached I-94 you can remain in US and can work in US till I-94 exiry date. Visa stamp is just for entry to US
Is it to be done before 20 april 2007 or can you wait until you want to leave the country for some reason like many do for their first 3 years?

Thank you.
