My spouse has applied for LC and under the 365-day rule can apply for 7th year extension at the end of 6 years (2005). However, since I have not applied for LC and my H1 also tends to end at the same time as my spouse's can I apply for 7th year extension based on my spouse's LC application. I am aware that the LC process would itself take another year and then the AOS would take about a year hopefully(2005). If everything goes well, we might not need a 7th year extension but if the Gc does not come thru by 2005 can I apply for 7th year extension based on my spouse's LC/GC application.
