H1 salary question - urgent

Hi, I have heard that if you are on H1, you should get minimum salary and so per year you should get minimum $45,000 salary. If you don't reach this amount, you are automatically be illegal or out of status. Please tell me is it true?

As one of my friend is not getting salary since january and so he will not get 45,000 at the end of the year. Will he get any trouble to fill next year text return? What should he do? He was on student visa and now convert to h1 visa so he doesn't go for stamping procedure yet.

Forgive me for bad grammar. Please help!!!
 
I don't think salary is a big concern for stamping.
INS considers salary if you have dependents applying for H4.
I got stamped with salary in offer showing 50K.

No idea about tax returns

Yes, you are rite.. Your friends H1B status shall be determined on the salary. As you said there should be a minimum salary. However, if you are not paid a minimum salary that is bad impact on your employer only.

As Nivas said it should be a major concern for an H1B stamping. But, you have to make sure that you have proper records from your employer that you are actually working for them.

He does not have any project on hand because market is down. So he is worring about his status. Also now it is not possible to get 45000 salary in next 6 months.
 
There is no bottom limit as such ... it depends on the prevailing wages for a particular occupation at a specific region, for details please read here.
 
When did his H1B become effective?
Anyway, he's out of status because he is not working, that's the mean problem the way I see it.
 
For visa stamping you should have a letter from the company stating current salary & employment. without latest paystub he will find it hard to get his visa stamped.
pay stub should show an amount atleast close to whatever company offer.

regarding tax return, it is unlikely they will ask for it. wiser to get it stamped sooner than later.
