H1 Revalidation

Hello ALL:

In order to revalidate H1-B, do I need to send an original I-797 or a photocopy is accepted ? I do not have the original but have a photocopy, is there a problem if I send a photocopy ? Thanks much.
 
Photocopy might not be acceptable. You need original or certified (attested copy) I797 to get the revalidation.

I had sent a photocopy (No attestation/not notarized) of the I-797 and got my visa re-validated with no problems

Below is a excerpt from the instruction on the DOS website.

As per instruction 3 on the above URL:
(3) A valid employment petition (Form I-797) issued by the INS must be submitted. The form will indicate the applicant’s current employer and the approved extension of temporary stay. A photocopy is acceptable.

Quick question, If I apply for revalidation with the photocopy and they refuse or ask for the original, do I have to pay all fees again ?

And, What should the letter from the employer say to justify for the extention ?

Any insight will be appriciated, Thanks.

As mentioned in the my earlier posting, a photocopy of the I-797 is acceptable by DOS. You don'thave to pay fees again if DOS asks for any more documentation. DOS will surely hane no issues with the photocopy of I-797 as mentioned in their posting on DOS URL. Please go to the link above for personal satisfaction.

Youe employer just needs to state that your curren positionin the company, your salary, your duties, and that employer will continue to hire to in the same position.

The letter from the employer should have the following information.

A comprehensive letter from the principal alien’s employer identifying the applicant and describing in detail the nature and function of thep osition, the kind of business and what it does, and justifying the need for the visa. The letter submitted must be on the letterhead of thei urrent employer, with an original signature from the company representative and must be addressed to the Visa Office, Department of State. The Visa Office cannot accept letters signed by the visa applicant. If the visa applicant is the sole employee of the company in the United States, the latest copy of the company’s FICA and IRS forms must be submitted along with the applicant’s letter of explanation. Please include the company’s fax number.

While revalidating, if we do not give the original I-797, how do we get the new I-94 stamped ? I believe, at the bootom of I-797 there is a I-94 card on which they stamp the new date for H-1 expiration.

or only visa stamp on the passport is sufficient ?

Department of State does not stamp on I94. They will put a new Visa stamp on your passport.
When you reenter USA, you will be issued a new I94 at the Port of Entry.
