I have got my I form I-797 A approved for my H1 transfer. My new petition is valid till June 2005. My previous company's Visa expires on Sept 2003( I don't know whether they have cancelled it or not ). I need to travel back to India in May 2003 for my marriage. I checked on the US department of State website (http://travel.state.gov/hlop.html ), it mentions that:

"A visa may be revalidated if it has a remaining validity of not more than sixty (60) days, or has not been expired for more than one year".

My question is: If I travel back to India on my old company's H1 will my wife get her H4 for my old company or for my new company
( I have only got the H1 petition approved by my new company its not yet stamped. ). If I send my passport to St. Louis for new stamping for my new company's H1 will they consider it ( its more than 60 days still left on my previous company's H1 to expire ). My I-485 has also been filed my my new company so I guess I need to bring her on my new company's H1.

What should I do? Should I send my passport to St. Louis for new VISA stamping ( remember there is still more than 60 days left on my previous company's H1 ). Please advice

Thank You,

The best thing for you to do is to apply for your H1 visa AND your wife's H4 visa at the same time in India. St. Louis will not give you a new visa since you have more than 60 days left on your current visa. Make sure to carry your current ORIGINAL H1 approval notice.
