H1 revalidation & new H1

HI ,

I have few questions My case is.
I had my old visa stamped on my passport expired on jan 6th 2003. but i had new h1 visa so i sent for visa revalidation in Feb 2003 to stloius/ D.C. in the meantime i had applied for H1 transfer.
I got back my passport saying "cancelled with out prejudice". Is it because my stamp expired in Jan 2003??
i didnt get revalidated reason "not clearly approvable at this time. must apply for new visa overseas. what does that mean. ??

Now i got a new job and i will be transferreing my H1 to the new company. Since my passport has a " cancelled without prejudice" on it will it effect my new h1 transfer??? please advise.

is the stamp on the passport only used for reentering the country or does it effect even visa tranfers form h1 to h1.

Since you applied for revalidation after the expiry of old visa, it got returned back.

The message means that, to get it stamped in passport you have to apply to US consulate outside usa.

VisaStamp in the passport is only for travel it does NOT affect your transfer.

Make sure you have a valid i94.

--- They revalidate the Visa if you send your Passport before expiry of your visa 60 days advance OR your Visa should not be expired more than than 1 year. When did you send Passport? Was it 60 days before of expiry of Visa? I don’t think they cancelled because expiry date of Jan 2003, Did you attach new H1 with new valid I-94 that came with your H1 transfer along with the expired I-94

------ Visa sticker is ONLY for Travel so that you can reach at POE and ask for admission to US. You can transfer your H1.
Did you belong to countries that are subject to special security clearance? If you are male between 16-45 age did you attach DS-157 with your Form, was your photo correct 2inch by 2 inch lookind direct in to camera, if you are citizen of India did you send $100+75= 175 with Money order, Casher check or demand draft (they don’t accept personal check) did you wrote on Money order, Cahier Check payable to “ US Department of State” did you send letter from your employer for requesting the H Visa?
did you over stayed in US in past or your new H1 was filed after your past H1 expired?
I did not figure out the reason for rejection, normally they send the reason for rejection. If you can figure out the reason and post it will help others

---- One can send the passport for Visa revalidation if the Visa was not expired more than 1 year and have valid H1 extension with extended I-94

Hi,

i have a valid H1, and i sent the valid I-94 expiring in oct 2005, i sent the photos,checks and letter from employer too. the only reason they have said is " not clearly approvable at this time. Must apply for new visa overseas".
i am from india, so not the case of those 4 countries.could it be that my valid I-94 was still stick to the H1 where as the expired I-94 was in the passport??? i didnt stick the valid one the teh passport. could this be the reason. since i have valid H1 till 2005 can i stay till that time?? Can i do a drop in when i go to india for revalidation????

--- What do you mean by” but i had new h1 visa” do you mean new H1 approval?
Did you fill up your Form DS-156 correctly? And provided every info?
Did you attach form DS-157 if you are Male? If yes, did you fill what countries you visited in last 10 years?
Did you visit or worked in any Muslim countries in past?

did you pay correct fees $175
Where did you got your past H1 visa sticker in passport

Because if you sent your new H1 approval you should have detached the I-94 from approval notice and should have attached to the passport (I don’t see this reason for visa refusal they can look at Approval and attached I-94)
Have you any past out of Status issue?
"in the meantime I had applied for H1 transfer" did your past employer revoked the H1? because they might have checked with the EAC or WAC, NSC # on your H1 approval notice that it has been revoked


Stamp expired in Jan 2003 can not be the only reason for refusal, I am just trying to figure out the reason

you can do it in India according to new cable sent to all consulates all Nonimmigrant visa applicant has to attend interview only 60 years old are exluded.
you can stay in US till the date you have valid I-94
