H1 Revalidation from St. Louis

All,

I am sending my Passport for h1 stamping from St. Louis. My prevuois company filed my I-140. If I say YES to question 36 in form DS-156 "Has anyone filed an immigrant Visa petition for you" Will it create any problems in the stamping. If it better if I say 'No'?


Do I need to send the original I-797A or a photo copy? How many photographs are required .. 1 or 2?

H1 is a dual intent visa (unlike visitor, student where you do not intent to immigrate).

If your I40 has been filed then some entity has applied for Immigrant visa for you. It's upto you whether you want to present the facts or not (which I strongly discourage).

You will have to send your original 797.
