H1 Revalidation and Green Card ( I-140 and I-485 )

Its been 365 days since my I-485 and I-140 was filed. My I-140 has been approved and I have an EAD. I am chaning the company and getting an h1 Transfer.

The reason I need H1 is to bring my wife to USA since I am still single.

The lawyer who is filing for H1 transfer has asked my I-140 and I-485 receipt #s? Is it necessary to give those receipt #s for H1 transfer? He is also asking the copies of the receipts for the same? What is the name of the form that needs to be filled for filing h1 transfer?

Does BCIS send the h1 transfer information to the Nebraska Service centre where my I-140 and I-485 were filed? Will it cause any problems in my I-485 approval?

you dont need I140, I485 receipts. The form to file for H1 extension transfer is I129 ( and related forms).
Most probably lawyer wants to represent 140, 485 etc. (They send a G28 for each pending application)
Tell the lawyer right now you want representation for H1 transfer only.

I have one more question regaring the form I-129. This is an H1 transfer case

In Part 2 subsection 2 my lawyer has check option (a) New Employment

and has not given the EAC # in Subsection 3.

But in subsection 4 he has checked option (c) Extend or amend the stay of the person(s) since they now hold this status.

Will I be able to get the VISA stamped from St. Louis or do I need to go to New Delhi Consulate, India for that? Does it mean this will be a new H1 visa not an H1 transfer?


My previous company's lawyer had checked in option ( c ) Change in previously approved employment
and given the EAC no in the sunsection 3.

I would appreciate your reply on this one.
