H1 Renewal Stamp and I-485 Pending

I need some advice in my situation. I have my GC application pending and I have filed I-485. I want to get my H1-B stamped from Canada. On form DS156 I will mark YES to the question where they ask If a Immigration Petition has ever filed. Would my green card process effects me in any way?


Any help will be greatly appreciated.

why do you need VISA stamp?

Hello...

I don't understand you have Advance Parole with you then why do you need VISA stamp?

Mostly people keep valid I797 document along with AP; only you need VISA if you travel outside of contry..

I may miss understood....please correct me If I am wrong.

No, it will not affect your green card process anyway. The H visa is unique in this sense which allows you to maintain dual intent.(This has been explained in depth on Murthy.com) Answer "Yes" to the question, I think there is another field which asks who has filed immigrant petiton(will be "Employer" in your case), and you should be good.
 
I do not have the AP with me at the moment. Should I request it? The reason I want to go to Canada is that my immigration for Canada was approved. Once I land there I want to come back to US.

I was not sure on what document I will re-enter into the US as for my H-1 I do not have it stamped on my passport.

BadeMiyan question for you would it matter as my H1 is with one employer and my I-485 with the other.

If you do not have H1 stamped then the only option for you is to travel back on AP. This may cause problems and I would request you seek advise from your attorney for the same.

In my opinion you would be better off getting your H1 visa stamped in Canada (when you are there for landing) and travel back on H1.
