H1 renewal - Filing deadline missed.

My current H1 expired Oct 1, 2003. My company filed for the extension (sent it out on October 1st, 2003), and so the BCIS received it October 2nd, 2003. (Still waiting for receipt).

Am I currently out of status since the filing day is one day after the visa expired?

What are my recommended options? Shall I continue working and risk working illegally, and file for premium processing ASAP.

nope, since oct 1 the policies of BCIS are not very strict. you will be considered out of status for the period from Oct 1 to the receipt date of h1 extension, should not be more than 1-2 weeks
