H1 Renewal and Passport expiration

Hi All,

I was issued a H1 in October 2003 which was valid till 25th april 2006 ...I guess the reason that it was not stamped for three years was because my passport was expiring on June 2006 ...Now my H1 is expiring on 25th april and my employer applied for renewal petition and its approved at the moment. I contacted the Indian Consulate in NY and they exteneded my passport for one more year so my passport is valid till april 2007.

Now my question is can I go to Canada to get my H1 stamping done on this passport which is valid till april 2007....

Somebody told me that H1 stamping does not depend on the passport expiration date...they will stamp the visa till whenever they want and if my passport expires but visa is valid then I need to carry the old passport with valid visa and new passport ....not sure how true is this ..? please somebody can throw some light on this.

yes, it is at the discretion of the consulate.

but why did you not get another pp valid for 10 years?

So you mean to say ...that they will stamp H1 for beyond the date of passport expiration date... I dint understand what u said ...whether thats yes or no ...or .depends on that day ...?

....thats a different issue ...my current passport was issued in tatkal ...so it was of 5 year validity ...so in this case I need to get it extended to 10 year and I cant get a new 10 year validity passport and for that extension I need to go to India. that whole thing itself is complicated.

So I was wondering if I can get the H1 stamped here ...then I can whenever I want and get my passport extended ...for 4 more year ..and there will not be any issue.

do know of a case where the visa was issued until 2009 when the pp expired in 2008. but, it was too early for this person to apply for pp renewal.

somewhat confused by what you are mentioning regarding pp extension. if one's 10-year validity indian pp expired, one would need to visit india to get anther 10-year validity pp? Is this understanding correct?

My passport expires before my H1 stamping on my passport. I just need to renew my passport and if I have to travel outside US I just need to carry both the passports.
 
Hi GC _Lover,

My passport expires is Sept 2007 and H1 B peition petition is valid till feb 2009.
I have an appt in Canada to get my H1 B stamped. This is the first time I would go..
How many yrs Visa can I expect? Is it till my passport expiry or till my I 797?

You mentioned that your passport expires before your H1 B visa..What was ur situation? How may yrs visa did u get?
