H1 Rejection Issue

Hi,
I am working for Employer A and I was on I was on Bench for some time. Employer B has approached me and filed my H1 Transfer. They could not find a job and I got a job with Employer A. My H1 with Employer A is valid till 2009. Employer B could not find a job and it seems that they have Withdrawn my H1 B.
I have received a letter in my Wife’s name (For H4) saying that principal aplicant’s application has been withdrawn and H4 has been rejected.
Also, mentioned that the person needs to deport and living without proper authorization is illegal. Should you have any questions. Call so and so number.
H1 rejection must have gone back to Employer B and they did not update me on this. They are keep on saying that they are looking for a job, while I am working with Employer B. I have asked them, after looking at rejection notice for H4 and they are saying that it’s been withdrawn.
Now my questions are:
1. Is that (H1 and H4) Cancelled by saying Withdrawn?
2. Our H1 and H4 are valid with Employer A till 2009, where as this new H4 has been rejected, since my H1 has been withdrawn. So, do we need to call USCIS and update about the H1 approval from Employer A?
3. Or Should we leave it as it is, since we have got the approval from Employer A?
4. Since this notice reached us, Will it be updated with Immigration department about the deportation notice?
5. Will that cause any problem while entering US?
6. We need to go for Stamping with our I94 extension from Employer A, if we go out of US. Does it (The notice) affect us in any manner?

Please answer my question ASAP.

Thanks.

Since your Visa from Company A is Valid your status is legal. If you are going for stamping out side the country keep your second rejection notice with you. Incase if they ask you question about company B just reply that Position offered to you with company was discontinued or they do not have position anymore. On this bases your second company has withdrawn H1B case.

Remember you can hold multiple H1B visa but you can work with only one of them.
You should leave company B on the side just keep good documentation of company A.

Keep in mind your status is valid till company keeps you on the payroll. They don’t necessary need to pay you the salary offered to you even less amount is fine.

H4 to H1B

My husband is an H1B holder and I am an H4. I have found an employer who wants to consider me for hiring but requires a SSN which maynot have as an H4. This is a vicious circle - what should an employer do to start my paperwork and what is the approximate time of this legal procedure?

To work with employer you found you will need to transfer your H4 visa to H1
You can file for H1B nexy year in April 2008 and it will take month or some thing to get your visa approved .
ask your employer to consult a good lawyer to help you with the process
