H1 question

First of all sorry for posting this here....

One of my friend wanted to know whether he can go to India while his H1 transfer is in pending. He worked for Company A and now joined Company B. Company B filed his H1 transfer but not yet approved, he needs to go to India for emergency reasons.

It will be really helpful if you throw some light on this.

Yes He should be able to ,Provided

He has a valid Visa stamp in his passport to return back to US .

But plz ask him to verify this with an attorney before leaving .

I wouldn't leave the country until the the tranfer was approved and the new papers were in my hand. If he's already started working for the new company and is on its payroll, it might be safe possibly. Probably worth asking the attorney.
